I am not sure on the guidelines for photos in infoboxes but I couldn't find anything recent in c:Category:Kathy Bates, our freely licenced file resposity where we can draw photos of living people from. Anyone is welcome to take a photo of Bates or find a freely licenced one, we can't take a random file off the internet though. It also raises the question, if Bates puts on 200 pounds in the next 5 years do we pick a recent picture then or keep an older, more flattering one? Why no mention of "Chéri" 2009 film starring Bates, Michelle Pfeiffer and Rupert Friend?
